Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the DirectWayzGH platform ("Platform"), operated by SKILLFIND HUB ("Company"), a registered sole proprietorship in Ghana (Reg. No. BN265650326). By using the Platform, you agree to these Terms.

2. The Platform

DirectWayzGH is an online marketplace that connects customers seeking professional services with independent service providers ("Professionals"). The Platform facilitates the posting of jobs, bidding by Professionals, communication between parties, and secure payment processing. The Platform also allows users to submit area expansion requests to indicate demand for services in their neighbourhood. Submitting an area request does not guarantee that DirectWayzGH will expand to that neighbourhood. Area requests are used for internal planning purposes only.

3. User Accounts

3.1 You must provide accurate information when creating an account. 3.2 You are responsible for maintaining the security of your account credentials. 3.3 You must be at least 18 years old to use the Platform. 3.4 DirectWayzGH reserves the right to suspend or terminate accounts that violate these Terms.

4. For Customers

4.1 Posting a job is free of charge. 4.2 A service fee of 10% is added to the Professional’s quoted price when payment is made. 4.3 Payment is held in escrow by the Platform until the customer confirms job completion. 4.4 If the customer does not confirm or report an issue within 48 hours of the Professional marking the job as complete, payment is automatically released to the Professional. 4.5 Cancellation Policy: (a) Jobs that have not yet received bids, or are still in the bidding stage, may be cancelled by the customer at any time with no fee. (b) Jobs where a bid has been accepted but payment has not yet been completed may be cancelled by the customer at no cost. The accepted Professional is released from the commitment and their bid is made available again. (c) Jobs that are in progress (payment collected, Professional dispatched) may be cancelled by the customer subject to a cancellation fee of GHS 50 or 30% of the agreed job amount, whichever is lower. This fee compensates the Professional for their time and transport costs. The remainder of the payment is refunded to the customer. (d) Jobs that have been marked as completed cannot be cancelled. Customers must use the Satisfaction Protection dispute process (Section 7) to address any concerns with completed work. 4.6 After accepting a bid, the customer has 2 hours to complete payment. If payment is not completed within this period, the job is automatically unlocked and reopened for new bids. The previously accepted Professional is released from the commitment.

5. For Professionals

5.1 Registration is free of charge. 5.2 Professionals are independent contractors, not employees, agents, or partners of DirectWayzGH. 5.3 Professionals set their own prices and are responsible for the quality of their work. 5.4 Professionals must provide accurate information and valid identification for verification. 5.5 Professionals receive payment via Mobile Money or bank transfer after customer confirmation. 5.6 Professionals are responsible for their own taxes, insurance, and compliance with applicable laws. 5.7 Bid confidentiality: bid details (including amounts and Professional identity) are visible only to the customer who posted the job. Competing Professionals cannot see each other’s bid amounts or details.

6. Payments

6.1 All payments are processed through Paystack, a licensed payment service provider. 6.2 DirectWayzGH accepts MTN Mobile Money, Vodafone Cash, AirtelTigo Money, and bank/debit cards. 6.3 Funds are held in escrow until the customer confirms job completion or a dispute is resolved. 6.4 In the event of a dispute, funds remain in escrow until the admin reaches a resolution. 6.5 For partial refunds, the escrow amount is split according to the admin’s decision — the refund percentage is returned to the customer and the remainder is released to the Professional. 6.6 Refunds, where applicable, are processed within 3–5 business days. 6.7 All transactions on the Platform are conducted in Ghana Cedis (GHS). International payment methods are accepted; currency conversion is handled by the customer’s bank or card issuer at the prevailing exchange rate. 6.8 After accepting a Professional’s bid, the customer must complete payment within 2 hours. Failure to do so will result in the job being automatically unlocked and the bid being released.

7. Satisfaction Protection (Dispute Resolution)

7.1 Every job on DirectWayzGH is covered by our Satisfaction Protection policy. 7.2 If a customer is not satisfied with the work performed, they may file a dispute by clicking the “Report an Issue” button on the job details page while the job status is In Progress or Completed. 7.3 To file a dispute, the customer must select an issue type (e.g., quality issue, incomplete work, property damage, no-show), provide a written description, and may upload up to 5 photos as evidence. 7.4 Only one dispute may be filed per job. Duplicate disputes for the same job are not allowed. 7.5 A DirectWayzGH admin will review the dispute within 24 hours of submission. 7.6 The Professional has the right to respond to the dispute with their own account of events. 7.7 After review, the admin will determine one of the following resolutions: (a) Full refund — the entire escrow amount is returned to the customer; (b) Partial refund — a percentage of the escrow amount (determined by admin based on the issue) is returned to the customer, and the remainder is released to the Professional; (c) Redo — the Professional returns to fix the issue at no extra cost to the customer; or (d) Claim denied — if the evidence does not support the customer’s claim, the escrow is released to the Professional. 7.8 All refunds are processed from the escrow payment held by the Platform. DirectWayzGH does not pay refunds out of its own funds. 7.9 DirectWayzGH’s decision in dispute resolution is final and binding on both parties. 7.10 Filing false, fraudulent, or bad-faith disputes may result in immediate account suspension or termination.

8. Limitation of Liability

8.1 DirectWayzGH is a marketplace platform that connects Customers with independent Professionals. DirectWayzGH does not employ, supervise, or control Professionals. 8.2 DirectWayzGH’s total liability in any dispute or claim is limited to the amount paid through the Platform for the specific job in question. DirectWayzGH is not liable for any damages, losses, or costs that exceed the agreed job amount. 8.3 DirectWayzGH is not responsible for the quality, safety, legality, or timeliness of services provided by Professionals. 8.4 Professionals are solely responsible for any property damage, personal injury, or other harm caused during or as a result of their services. Such matters are between the Customer and the Professional. 8.5 DirectWayzGH does not guarantee the availability of Professionals in any area or category.

9. Prohibited Activities

9.1 Users shall not: (a) Provide false or misleading information; (b) Use the Platform for any unlawful purpose; (c) Harass, threaten, or abuse other users; (d) Attempt to circumvent Platform payments (e.g., arranging direct cash payments); (e) Create duplicate accounts; (f) Submit fraudulent dispute claims; (g) Share personal data of other users with third parties.

10. Intellectual Property

10.1 The DirectWayzGH name, logo, and platform design are the property of SKILLFIND HUB. 10.2 Users may not copy, modify, or distribute any part of the Platform without written permission.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

12. Changes to Terms

DirectWayzGH reserves the right to modify these Terms at any time. Users will be notified of significant changes via email or in-app notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes shall be resolved through arbitration in Accra, Ghana.
